Terms of Service

§1Acceptance of These Terms

These Terms of Service ("Terms") form a legally binding agreement between you and fzkaipeng.com, registered at Sheffield Science Park, Sheffield, United Kingdom. By downloading, installing, accessing, or otherwise using the Services, you agree to these Terms, our Privacy Policy, and any additional terms presented at the point of purchase. If you do not agree, do not use the Services.

You may also be subject to the terms of the third-party platform through which you obtained the Services (the "Platform"). In the event of a conflict, the Platform's terms control in relation to the Platform's obligations.

§2Eligibility and Age

You must be at least 13 years old (or older, as required by local law) to use the Services. If you are between 13 and the age of majority, you confirm that you have your parent or guardian's permission. Where an app is identified as appropriate for children, additional rules apply — see our Children's Privacy provisions.

You also represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

§3License Grant

Subject to your compliance with these Terms and any applicable payment obligations, fzkaipeng.com grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Services for your personal, non-commercial purposes, on any device you own or control. The Services are licensed, not sold; title and intellectual property remain with fzkaipeng.com or its licensors.

You may not copy, modify, adapt, translate, reverse-engineer, decompile, or disassemble the Services (except as permitted by applicable law); rent, lease, sublicense, distribute, or transfer the Services; remove or alter proprietary notices; use the Services to provide commercial services to third parties; bypass technological protection measures; or use the Services in connection with any unlawful or harmful activity.

§4App Store Specific Terms

If you obtained the Services through a Platform:

4.1 Apple App Store

These Terms are between you and fzkaipeng.com only, not Apple Inc. Apple has no obligation to provide maintenance or support, and is not responsible for warranty claims. Refund requests are governed by Apple's refund policy; we may but are not obliged to issue refunds outside Apple's process.

4.2 Google Play

These Terms are between you and fzkaipeng.com only. Google LLC is not a party. Refunds are governed by Google's refund policy.

4.3 Microsoft Store

Refunds are governed by Microsoft's refund policy.

4.4 Amazon Appstore

Refunds are governed by Amazon's refund policy.

4.5 Huawei AppGallery, Samsung Galaxy Store, Snap Store, others

Each platform's terms apply to the use of the Services obtained through it.

§5Subscriptions and Payments

Some of our Services are offered on a paid or subscription basis. By purchasing a subscription or one-off payment, you authorise us (or the Platform) to charge your payment method the applicable fees plus any taxes. Fees are stated in the currency of your storefront and may be converted by your card issuer or bank.

  • Billing cycle: monthly, annual, or as stated at purchase.
  • Auto-renewal: subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
  • Price changes: we will provide at least 30 days' notice of any price change, after which you may cancel.
  • Taxes: prices are exclusive of applicable sales tax, VAT, GST, or other transaction taxes, which are added at checkout.

§6Refunds and Cancellations

Except where required by law, fees are non-refundable. Where a refund is permitted by the Platform, the refund is governed by that Platform's policy. Apple allows refund requests within 14 days via reportaproblem.apple.com; Google Play offers a 48-hour window in some regions; Microsoft Store offers 14 days in some regions; Amazon Appstore offers 3 days in some regions. For EU and UK consumers, where you expressly consent to immediate performance and acknowledge the loss of the withdrawal right, the 14-day right of withdrawal does not apply. You may cancel a subscription at any time via the Platform's subscription management screen.

§7Free Trials and Promotional Codes

Free trials convert to paid subscriptions at the end of the trial unless cancelled at least 24 hours before the end. We may revoke a trial for abuse. Promotional codes have no cash value, are non-transferable, and may be limited to specific products, regions, or users.

§8User Content and Intellectual Property

You retain all rights in your User Content. You grant fzkaipeng.com a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process your User Content solely as necessary to operate the Services for you; this license terminates when you delete the content or close your account. You confirm that you own or have the necessary rights to your User Content and that it does not infringe any rights. All intellectual property in the Services is owned by fzkaipeng.com or its licensors; nothing transfers ownership to you.

§9Acceptable Use

You agree not to use the Services for any unlawful purpose; to infringe any rights; to upload or transmit malware or harmful code; to attempt to gain unauthorised access; to reverse-engineer (except as permitted by law); to interfere with or disrupt the Services; to harvest or scrape data; to impersonate; to bypass security features; or to use the Services in connection with the training of machine learning models without our prior written consent. We may investigate any suspected violation and take appropriate action, including suspension, termination, and reporting to authorities.

§10Third-Party Services

The Services may integrate with third-party services (payment processors, cloud sync, analytics, advertising networks). Your use of those services is subject to their own terms. We are not responsible for the acts or omissions of any third party.

§11Updates and Changes to the Services

We may update the Services at any time. Updates may install automatically. Where an update materially reduces functionality, we will provide notice where practicable. We may withdraw features; we will provide at least 30 days' notice for any feature you materially rely on. We may update these Terms from time to time. Material changes will be communicated via in-app notice, email, or a website banner.

§12Warranties and Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.

§13Limitation of Liability

To the maximum extent permitted by law, in no event shall fzkaipeng.com, its affiliates, officers, directors, employees, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, use, data, or other intangible losses, whether in contract, tort (including negligence), statute, or otherwise, even if advised of the possibility. Our aggregate liability for any claim shall not exceed the greater of (i) the amount you paid us for the Services in the 12 months preceding the claim, or (ii) £100. Nothing in this section limits liability that cannot be excluded under applicable law.

§14Indemnification

You agree to defend, indemnify, and hold fzkaipeng.com and its affiliates harmless from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Services, your User Content, or your breach of these Terms.

§15Termination

These Terms remain in effect until terminated. You may terminate by uninstalling and discontinuing use. We may terminate or suspend your access at any time, with or without notice, for any breach or any other reason. Upon termination, licenses end and you must cease all use. Sections that by their nature should survive (payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution) survive termination.

§16Governing Law

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws rules. The mandatory consumer protection laws of your country of residence remain unaffected.

§17Dispute Resolution

We aim to resolve disputes informally — contact contact@fzkaipeng.com first; we will attempt to respond within 30 days. For consumers in the EEA, UK, or other jurisdictions with mandatory consumer arbitration or mediation rights, you may use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr). For business-to-business disputes, the exclusive forum is the courts of England and Wales.

§18Export Controls

You agree to comply with all applicable export control and sanctions laws, including the U.S. Export Administration Regulations, the EU Dual Use Regulation, and the UK Strategic Export Controls.

§19Accessibility

We design the Services with accessibility in mind and target conformance with WCAG 2.2 Level AA. We support Dynamic Type, VoiceOver, TalkBack, Switch Control, Voice Control, Increase Contrast, Reduce Motion, and platform-native accessibility features. If you encounter an accessibility barrier, contact accessibility@fzkaipeng.com.

§20DMCA / Copyright Complaints

If you believe your copyrighted work has been infringed, send a written notice to our designated agent at dmca@fzkaipeng.com or by post to fzkaipeng.com, Sheffield Science Park, Sheffield, United Kingdom. The notice must include a physical or electronic signature; identification of the copyrighted work; identification of the infringing material; your contact information; a good-faith belief statement; and a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorised agent. We follow the EU Copyright Directive (Article 17) and equivalent national implementations, and may terminate the accounts of repeat infringers.

§21Miscellaneous

  • Severability: if any provision is unenforceable, the remaining provisions remain in full force.
  • Waiver: failure to enforce any right is not a waiver.
  • Assignment: you may not assign without our written consent; we may assign to an affiliate or in connection with a merger or sale.
  • Entire agreement: these Terms, the Privacy Policy, and any Platform terms form the entire agreement.
  • Force majeure: neither party is liable for failure caused by events beyond reasonable control.
